Welcome to WishApp. By using our application, you agree to these Terms of Service.

1. Acceptance of Terms

By downloading, installing, or using WishApp, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Description of Service

WishApp is a mobile application that helps you:

• Store and manage birthday and anniversary dates of your contacts
• Receive reminders for upcoming birthdays and anniversaries
• Generate and send birthday/anniversary greeting cards
• Send wishes via WhatsApp and SMS
• Sync contacts from phone and Google Contacts
• Discover birthdays from the WishApp community
• Securely backup and restore your app data to the cloud

3. User Responsibilities

As a user of WishApp, you agree to:

• Provide accurate information
• Use the app only for lawful purposes
• Not misuse the automated messaging feature for spam or harassment
• Respect the privacy of your contacts
• Comply with WhatsApp's terms of service when sending messages
• Ensure birthday/anniversary data shared with the community is accurate
• Remember your backup PIN — we cannot recover encrypted backups if the PIN is lost

4. Community Features

By enabling community features (Community Sharing and Auto-import), you agree that:

• Birthday and anniversary data you share may be used by other WishApp users
• Phone numbers are hashed (SHA-256) for privacy — other users cannot see raw phone numbers
• You have the right to share the birthday information you upload
• Community data accuracy is not guaranteed — birthdays are user-submitted
• You can opt out of community features at any time in Settings

5. Cloud Backup

• Cloud backup is provided as a convenience feature with no guaranteed uptime or availability
• Backups are encrypted with your personal PIN — we cannot recover data if you forget your PIN
• We are not responsible for data loss due to server issues, maintenance, or account deletion
• Maximum backup size is limited to 5MB per user
• We reserve the right to delete inactive backups after 12 months of inactivity

6. Account and Data

You are responsible for maintaining the security of your device and your backup PIN. WishApp is not liable for any loss or damage arising from unauthorized access to your device or forgotten backup PINs.

7. Third-Party Services

WishApp integrates with third-party services including Google and WhatsApp. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability or functionality of third-party services.

8. Intellectual Property

All content, features, functionality, design, and code of WishApp are owned by the developer (Satish Ranka) and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the app without prior written permission.

9. Disclaimer of Warranties

WishApp is provided "as is" without warranties of any kind, express or implied. We do not guarantee that:

• The app will be error-free or uninterrupted
• Birthday data from the community will be accurate
• Messages will be delivered successfully via WhatsApp or SMS
• Cloud backup and restore will always function correctly
• Birthday auto-save to phone contacts will work on all devices

10. Limitation of Liability

To the maximum extent permitted by law, WishApp and its developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to missed birthdays, incorrect dates, failed message delivery, data loss, or failed backup/restore operations.

11. Message Delivery

While we strive to deliver messages reliably, we cannot guarantee delivery of WhatsApp or SMS messages. Message delivery depends on network conditions, WhatsApp/messaging app availability, device permissions, and other factors beyond our control.

12. Modifications

We reserve the right to modify these Terms of Service at any time. Continued use of the app after changes constitutes acceptance of the new terms.

13. Termination

We reserve the right to terminate or suspend access to community features for users who violate these terms, upload inaccurate data, or misuse the service.

14. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Nagpur, Maharashtra, India.
